Acuerdo de Venta

Este contrato se emite para cumplir con la obligación de firmar un contrato para las compras realizadas a través de Internet, en virtud de las disposiciones del Reglamento sobre Procedimientos y Principios de los Contratos de Venta a Distancia, publicado en el Boletín Oficial número 25137, con fecha 13.06.2003. En consecuencia:

1. OBJETO

El objeto de este contrato incluye los derechos y obligaciones de las partes de conformidad con las disposiciones del Reglamento sobre Procedimientos y Principios de los Contratos de Venta a Distancia en relación con la Ley de Protección del Consumidor (número 4077), en lo referente a la venta del servicio ofrecido por el VENDEDOR al COMPRADOR. Las características del VENDEDOR se indican a continuación.

2.1. INFORMACIÓN DEL VENDEDOR

2.2. INFORMACIÓN DEL COMPRADOR

El cliente es miembro del sitio web de excursiones www.expertastravel.com. Se tomarán como referencia los datos de contacto y dirección proporcionados durante el registro.

3. INFORMACIÓN SOBRE EL SERVICIO SUJETO AL CONTRATO

Incluye información sobre el tipo, cantidad, marca/modelo, color, precio de venta y método de pago del servicio válido al momento de finalizar el pedido.

4. DISPOSICIONES GENERALES

El COMPRADOR reconoce y acepta que ha leído y comprendido completamente la información preliminar sobre las características básicas, precio de venta y método de pago, así como sobre la entrega del servicio(s) sujeto(s) a este contrato, tal como se indica en el Artículo 3, y que ha otorgado la confirmación requerida en el entorno electrónico.
El/los servicio(s) sujeto(s) a este contrato deberán entregarse al COMPRADOR o a la persona/entidad legal en la dirección proporcionada dentro del plazo especificado para cada servicio en la información preliminar, según la distancia de la ubicación del COMPRADOR, sin exceder el límite legal de 30 días bajo ninguna circunstancia. Este plazo podrá ampliarse solo por 10 días con previo aviso al COMPRADOR.
Si el servicio sujeto al contrato debe entregarse a otra persona/entidad legal distinta al COMPRADOR, Expertas Travel Tourism and Trade LLC no será responsable de la negativa de dicha persona/entidad legal a recibir la entrega, cuando corresponda.
Expertas Travel Tourism and Trade LLC será responsable de la entrega del servicio en cuestión que cumpla con las características establecidas en el pedido, en buen estado y completo, junto con los certificados de garantía y guías de usuario, si corresponde.
Tras la entrega del servicio, si el precio del mismo no es transferido a Expertas Travel Tourism and Trade LLC por el banco emisor o la institución financiera debido al uso ilegal de la tarjeta de crédito del COMPRADOR por parte de una persona no autorizada, sin el consentimiento y sin culpa del COMPRADOR, este estará obligado a devolver el producto entregado a las direcciones de contacto de Expertas Travel Tourism and Trade LLC dentro de los 3 días. En este caso, el costo de la entrega será asumido por el COMPRADOR.
Expertas Travel Tourism and Trade LLC notificará al COMPRADOR sobre cualquier falla en la entrega del servicio en cuestión dentro del período especificado debido a fuerza mayor, condiciones climáticas adversas, interrupciones en el transporte, etc. En este caso, el COMPRADOR tendrá derecho a elegir una de las siguientes opciones: cancelación del pedido, reemplazo del servicio del contrato por un servicio equivalente, y/o aplazamiento del tiempo de entrega hasta que la situación sea superada. Si el pedido es cancelado por el COMPRADOR, el monto pagado será reembolsado al COMPRADOR en su totalidad en efectivo dentro de los 3 días.

5. DERECHO DE DESISTIMIENTO

El COMPRADOR tendrá derecho a desistir del contrato hasta 24 horas antes de la entrega del servicio (tours, excursiones, viajes, etc.) al COMPRADOR o a la persona/entidad legal en la dirección proporcionada. Para ejercer el derecho de desistimiento, el COMPRADOR deberá notificar a Expertas Travel Tourism and Trade LLC durante este período por fax, correo electrónico o teléfono. Además, el servicio no deberá haber sido utilizado, de conformidad con las disposiciones del artículo. En caso de que el COMPRADOR ejerza este derecho, el comprobante de entrega del transportista que acredite la entrega del servicio a terceros o al COMPRADOR, así como el original de la factura del producto, deben enviarse a las direcciones de contacto de Expertas Travel Tourism and Trade LLC.
Dentro de los 7 días siguientes a la recepción de dichos documentos, el precio del servicio será reembolsado al COMPRADOR. Si no se envía la factura original, el IVA y otras responsabilidades legales, si las hubiera, no serán reembolsadas al COMPRADOR. Los costos de devolución, si los hubiera, relacionados con el servicio objeto de desistimiento serán asumidos por el COMPRADOR.
El consumidor puede solicitar la cancelación del pago si la tarjeta de crédito o de pago ha sido utilizada por personas no autorizadas, de manera ilegal y sin su consentimiento. En este caso, el emisor de la tarjeta devolverá el pago al consumidor dentro de los 10 días siguientes a la notificación de la objeción.

En relación con la ejecución de este contrato, serán competentes los Tribunales de Consumo ubicados en el área de residencia de Expertas Travel Tourism and Trade LLC, así como las juntas de arbitraje anunciadas por el Ministerio de Industria y Comercio.

Al realizar el pedido, el COMPRADOR se considera que ha aceptado todos los términos y condiciones de este acuerdo.

Distance Sale Agreement

This contract has been issued to meet the liability of signing a contract for the purchases made over the Internet by force of the provisions of the Regulation on Procedure and Principle of the Distance Sales Contracts published in the Official Gazette numbered 25137, dated 13.06.2003. Accordingly,

1. SUBJECT

The subject of this contract covers the rights and obligations of the parties following the provisions of the Regulation on Procedure and Principle of the Distance Sales Contracts regarding the Consumer Protection Law (numbered 4077), in terms of the sale of the service sold by the SELLER to the BUYER. The characteristics of the seller are indicated below.

2.1. SELLER INFORMATION

2.2. BUYER INFORMATION

The customer is a member of the excursion site named www.expertastravel.com. The address and contact information provided in the subscription will be taken as the basis.

3. INFORMATION ABOUT THE SERVICE SUBJECT TO THE CONTRACT

It comprises the information regarding the type, quantity, brand/model, color, selling price, and payment method for the Services valid when the order is finalized.

4. GENERAL PROVISIONS

The BUYER acknowledges and agrees that the BUYER has read and fully understood the preliminary information about the basic qualifications, selling price, and payment method as well as the delivery of the service(s) subject to this Contract as indicated in Article 3 and that the BUYER has provided the required confirmation in the electronic environment.
The service(s) that is subject to this agreement should be delivered to the BUYER or the person/legal entity at the provided address within the period as set for each service in the preliminary information based on the distance of the BUYER’s current location, without exceeding the legal time limit of 30 days for any reason whatsoever. This period can be extended only for 10 days upon prior notice to the BUYER.
If the service subject to the contract is to be delivered to another person/legal entity other than the BUYER, Expertas Travel Tourism and Trade LLC shall not be liable for the refusal of the delivery by the said person/legal entity, where applicable.
Expertas Travel Travel Tourism and Trade LLC shall be responsible for the delivery of the concerned service that carries the qualifications as set in the order in good condition and complete together with the guarantee certificates and user guides, if any.
Upon delivery of the service, if the price of the service is not transferred to Expertas Travel Tourism and Trade LLC by the issuer bank or financial institution due to illegal use of the BUYER’s Credit Card by an unauthorized person without BUYER’s consent and fault, the BUYER shall be liable to return the delivered product to contact address(es) of Expertas Travel Tourism and Trade LLC within 3 days. In this case, the delivery cost shall belong to the BUYER.
Expertas Travel Tourism and Trade LLC shall notify the BUYER for any failure to deliver the service in question in the specified period due to force majeure, adverse weather conditions transportation disruption, etc. In this case, the BUYER shall be entitled to select one of the following options: cancellation of the order, replacement of the contract service with an equal service, and/or postponing the delivery time until the condition is eliminated. If the order is canceled by the BUYER, the paid amount shall be reimbursed to the BUYER fully in cash within 3 days.

5. RIGHT OF WITHDRAWAL

The BUYER shall be entitled to withdraw 24 hours (latest) before the delivery of the service (tours, trips, excursions, etc.) subject to the contract to the BUYER or the person/legal entity at the provided address. To use the withdrawal right, the BUYER shall notify Expertas Travel Tourism and Trade LLC during this period via fax, e-mail, or phone. Also, the service shall be unused, following the provisions of the article. In case the BUYER uses this right, the carrier’s delivery notice evidencing the service given to the third parties or the BUYER, as well as the original of the product invoice must be sent to Expertas Travel Tourism and Trade LLC contact addresses. Within 7 days following the receipt of the said documents, the price of the service shall be reimbursed to the BUYER. If the original invoice has not been sent, VAT and other legal liabilities, if any, shall not be reimbursed to the BUYER. The return costs, if any, regarding the service subject to withdrawal shall belong to the BUYER.
The consumer can request the cancellation of the payment because the credit card or payment card has been used by unauthorized persons, illegally and without his/her consent. In this case card issuer returns the payment to the consumer within 10 days following the notification of the objection.
Regarding the execution of this contract, the Consumer Courts located in the residential area of Expertas Travel Tourism and Trade LLC as well as the arbitration boards as announced by the Ministry of Industry and Trade are authorized.

Upon placing the order, the BUYER is deemed to have accepted all terms and conditions of this agreement.

Mesafeli Satış Sözleşmesi

İşbu sözleşme, 13.06.2003 tarih ve 25137 sayılı Resmi Gazete’de yayımlanan Mesafeli Satış Sözleşmeleri Uygulama Usul ve Esasları Hakkında Yönetmelik hükümleri gereği internet üzerinden yapılan alışverişlerde sözleşme imzalama yükümlülüğünü karşılamak amacıyla düzenlenmiştir. Buna göre,

1. KONU

İşbu sözleşmenin konusu, SATICI’nın ALICI’ya satışını yaptığı hizmetin satışı ile ilgili olarak 4077 sayılı Tüketicinin Korunması Hakkında Kanun’a ilişkin Mesafeli Satış Sözleşmeleri Uygulama Usul ve Esasları Hakkında Yönetmelik hükümleri gereğince tarafların hak ve yükümlülüklerini kapsamaktadır. Satıcı’ya ait özellikler aşağıda belirtilmiştir.

Müşteri; www.expertastravel.com isimli gezi sitesine üyedir. Üyelikte verilen adres ve iletişim bilgileri esas alınacaktır.

3. SÖZLEŞME KONUSU HİZMETE İLİŞKİN BİLGİLER

Sipariş kesinleştiğinde geçerli olan Hizmetlerin türü, miktarı, marka/modeli, rengi, satış fiyatı ve ödeme yöntemine ilişkin bilgileri içerir.

4. GENEL HÜKÜMLER

ALICI, Madde 3’te belirtilen işbu Sözleşme konusu hizmet(ler)in temel nitelikleri, satış fiyatı ve ödeme şekli ile teslimata ilişkin ön bilgileri okuyup tam olarak anladığını ve elektronik ortamda gerekli teyidi verdiğini kabul ve beyan eder.
İşbu sözleşme konusu hizmet(ler)in, her ne sebeple olursa olsun 30 günlük yasal süreyi aşmamak kaydıyla, ALICI’nın bulunduğu yerin uzaklığı esas alınarak ön bilgilerde her bir hizmet için belirlenen süre içerisinde ALICI’ya veya gösterdiği adresteki gerçek/tüzel kişiye teslim edilmesi gerekmektedir. Bu süre ALICI’ya önceden bildirilmek kaydıyla sadece 10 gün uzatılabilir.
Sözleşme konusu hizmetin ALICI’dan başka bir gerçek/tüzel kişiye teslim edilecek olması halinde, teslimin söz konusu gerçek/tüzel kişi tarafından reddedilmesinden dolayı Expertas Seyahat Turizm ve Ticaret Limited Şirketi sorumlu olmayacaktır.
Expertas Travel Turizm ve Ticaret Limited Şirketi, siparişte belirtilen nitelikleri taşıyan ilgili hizmetin iyi durumda ve varsa garanti belgeleri ve kullanım kılavuzları ile birlikte eksiksiz olarak teslim edilmesinden sorumludur.
Hizmetin tesliminden sonra, ALICI’ya ait Kredi Kartının ALICI’nın izni ve kusuru olmaksızın yetkisiz bir kişi tarafından hukuka aykırı olarak kullanılması nedeni ile hizmet bedelinin kartı veren banka veya finans kuruluşu tarafından Expertas Travel Turizm ve Ticaret Limited Şirketi’ne aktarılmaması halinde, ALICI teslim edilen ürünü 3 gün içinde Expertas Travel Turizm ve Ticaret Limited Şirketi’nin iletişim adres(ler)ine iade etmekle yükümlüdür. Bu durumda teslimat masrafları ALICI’ya ait olacaktır.
Expertas Seyahat Turizm ve Ticaret Limited Şirketi, mücbir sebepler, olumsuz hava koşulları ulaşım aksaması vb. nedenlerle söz konusu hizmetin belirtilen sürede teslim edilememesi halinde durumu ALICI’ya bildirir. Bu durumda ALICI, siparişin iptal edilmesi, sözleşme konusu hizmetin eşdeğer bir hizmet ile değiştirilmesi ve/veya teslimat süresinin söz konusu durumun ortadan kalkmasına kadar ertelenmesi seçeneklerinden birini tercih etme hakkına sahip olacaktır. Siparişin ALICI tarafından iptal edilmesi halinde, ödenen tutar 3 gün içinde ALICI’ya nakden ve defaten iade edilir.

5. CAYMA HAKKI

ALICI, sözleşme konusu hizmetin (tur, gezi, gezi vb.) kendisine veya gösterdiği adresteki gerçek/tüzel kişiye tesliminden en geç 24 saat önce cayma hakkına sahiptir. Cayma hakkının kullanılması için ALICI’nın bu süre içinde Expertas Travel Turizm ve Ticaret Limited Şirketi’ne faks, e-posta veya telefon ile bildirimde bulunması gerekir. Ayrıca madde hükümlerine uygun olarak hizmetin kullanılmamış olması gerekir. ALICI’nın bu hakkını kullanması halinde, hizmetin üçüncü kişilere veya ALICI’ya verildiğini gösteren taşıma irsaliyesi ile ürün faturasının aslının Expertas Travel Turizm ve Ticaret Limited Şirketi iletişim adreslerine gönderilmesi zorunludur. Söz konusu belgelerin ulaşmasını takip eden 7 gün içerisinde hizmet bedeli ALICI’ya iade edilir. Fatura aslının gönderilmemesi halinde KDV ve varsa diğer yasal yükümlülükler ALICI’ya geri ödenmez. Cayma konusu hizmete ilişkin varsa iade masrafları ALICI’ya aittir.
Tüketici, kredi kartı veya ödeme kartının yetkisiz kişilerce, hukuka aykırı olarak ve rızası dışında kullanılması nedeniyle ödemenin iptalini talep edebilir. Bu durumda kartı çıkaran kuruluş, itirazın kendisine tebliğinden itibaren 10 gün içinde ödemeyi tüketiciye iade eder.
İşbu sözleşmenin ifası ile ilgili olarak Expertas Seyahat Turizm ve Ticaret Limited Şirketi’nin yerleşim yerinde bulunan Tüketici Mahkemeleri ile Sanayi ve Ticaret Bakanlığı tarafından ilan edilen hakem heyetleri yetkilidir.

ALICI, siparişi vermekle işbu sözleşmenin tüm hüküm ve şartlarını kabul etmiş sayılır.
